Seen in the recent Federal Fourth Circuit Court of Appeals<\/strong><\/em> opinion<\/a> regarding the\u00a0Trump Administration’s “Muslim ban” Executive Order:<\/p>\n

Invidious discrimination that is shrouded in layers of legality is no less an insult to\u00a0our Constitution than naked invidious discrimination. We have matured from the lessons\u00a0learned by past experiences documented, for example, in Dred Scott and Korematsu. But\u00a0we again encounter the affront of invidious discrimination\u2014this time layered under the\u00a0guise of a President\u2019s claim of unfettered congressionally delegated authority to control\u00a0immigration and his proclamation that national security requires his exercise of that\u00a0authority to deny entry to a class of aliens defined solely by their nation of origin. Laid\u00a0bare, this Executive Order is no more than what the President promised before and after\u00a0his election: naked invidious discrimination against Muslims. Such discrimination\u00a0contravenes the authority Congress delegated to the President in the Immigration and\u00a0Nationality Act (the \u201cImmigration Act\u201d), 8 U.S.C. \u00a7 1101 et seq., and it is\u00a0unconstitutional under the Establishment Clause.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"
