He\u2019s still\u00a0<a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/congress-has-authority-regulate-supreme-court-ethics-and-duty\" target=\"_blank\" rel=\"noopener\">wrong<\/a>. Since 1948, Congress has\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/455\" target=\"_blank\" rel=\"noopener\">required<\/a>\u00a0federal judges \u2014 including Supreme Court justices \u2014 to recuse themselves from deciding cases in which their \u201cimpartiality might reasonably be questioned.\u201d Is that unconstitutional? Since 1978, it has required federal judges \u2014 including justices \u2014 to file financial disclosure forms. Is that unconstitutional? (The justices, including Alito,\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/23789636-roberts-letter-to-durbin-4-25-2023\" target=\"_blank\" rel=\"noopener\">say they voluntarily<\/a>\u00a0follow those rules.) Since 1989, it has\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/101st-congress\/house-bill\/3660#:~:text=Ethics%20Reform%20Act%20of%201989%20%2D%20Title%20I%3A%20Post%20Employment%20Restrictions,the%20Government%20or%20the%20District.\" target=\"_blank\" rel=\"noopener\">imposed strict limits<\/a>\u00a0on outside income and gifts for federal judges \u2014 including justices. Is that unconstitutional? Just last year, Congress amended the\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/3059\/text\" target=\"_blank\" rel=\"noopener\">ethics rules to mandate<\/a> that federal judges \u2014 including justices \u2014 promptly disclose their stock transaction. Is that unconstitutional?<\/p>\n<\/blockquote>\n<p dir=\"null\" data-testid=\"drop-cap-letter\" data-el=\"text\">I can&#8217;t help but see such a law being appealed to, ummmm, <u><strong>SCOTUS<\/strong><\/u> eventually. And if the liberal wing was paying attention, they&#8217;d all recuse themselves. For obvious reasons.<\/p>\n<p dir=\"null\" data-testid=\"drop-cap-letter\" data-el=\"text\">Leaving the conservatives holding the bag. Find such a law unconstitutional?
