{"id":38472,"date":"2023-03-14T21:15:08","date_gmt":"2023-03-15T02:15:08","guid":{"rendered":"https:\/\/huewhite.com\/umb\/?p=38472"},"modified":"2023-03-14T21:15:08","modified_gmt":"2023-03-15T02:15:08","slug":"first-amendment","status":"publish","type":"post","link":"https:\/\/huewhite.com\/umb\/2023\/03\/14\/first-amendment\/","title":{"rendered":"First Amendment?"},"content":{"rendered":"<p>The <em><strong>Texas Tribune<\/strong><\/em> has a <a href=\"https:\/\/www.texastribune.org\/2023\/03\/10\/texas-abortion-lawsuit\/\" target=\"_blank\" rel=\"noopener\">story<\/a>:<\/p>\n<blockquote>\n<p class=\"t-copy t-links-underlined t-align-left\">A Texas man is suing three women under the wrongful death statute, alleging that they assisted his ex-wife in terminating her pregnancy, the first such case brought since the state\u2019s near-total ban on abortion last summer.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">Marcus Silva is represented by Jonathan Mitchell, the former Texas solicitor general and architect of the state\u2019s prohibition on abortions after about six weeks of pregnancy, and state Rep.\u00a0<a href=\"https:\/\/www.texastribune.org\/directory\/briscoe-cain\/\">Briscoe Cain<\/a>, R-Deer Park. The lawsuit is filed in state court in Galveston County, where Silva lives.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">Silva alleges that his now ex-wife learned she was pregnant in July 2022, the month after the overturn of Roe v. Wade, and conspired with two friends to illegally obtain abortion-inducing medication and terminate the pregnancy.<\/p>\n<\/blockquote>\n<p>To me, this sounds like a <em><a href=\"https:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a><\/em> case. Since the State government passed and enforces the law that allegedly gives this guy some right to sue the women, the government effectively is interfering with the women&#8217;s right to free speech.<\/p>\n<p>I&#8217;m sure some conservative lawyer will start screaming at the idea that the <strong>US Constitution<\/strong> applies in this case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Texas Tribune has a story: A Texas man is suing three women under the wrongful death statute, alleging that they assisted his ex-wife in terminating her pregnancy, the first such case brought since the state\u2019s near-total ban on abortion last summer.
