{"id":37368,"date":"2022-09-20T19:50:47","date_gmt":"2022-09-21T00:50:47","guid":{"rendered":"http:\/\/huewhite.com\/umb\/?p=37368"},"modified":"2022-09-20T19:50:47","modified_gmt":"2022-09-21T00:50:47","slug":"legal-wars","status":"publish","type":"post","link":"https:\/\/huewhite.com\/umb\/2022\/09\/20\/legal-wars\/","title":{"rendered":"Legal Wars"},"content":{"rendered":"<p>An opinion that sparks this sort of response seems likely to be a target of lawyers and satirists:<\/p>\n<blockquote><p>On Sept. 16, the Fifth Circuit issued its <a href=\"https:\/\/www.lawfareblog.com\/fifth-circuit-upholds-texas-social-media-law\">opinion<\/a> in NetChoice v. Paxton, upholding the controversial Texas law that limits the ability of large social media platforms to moderate content and also imposes disclosure and appeal requirements on them. The Fifth Circuit had previously stayed a district court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txwd.1147630\/gov.uscourts.txwd.1147630.51.0.pdf\">injunction<\/a> against the law, but the Supreme Court voted 5-4 to <a href=\"https:\/\/casetext.com\/case\/netchoice-llc-v-paxton-1\">vacate<\/a> the stay. The opinion opens up a stark circuit split with the Eleventh Circuit, which had <a href=\"http:\/\/ruled\/\">ruled<\/a> that a Florida law that also imposed content moderation restrictions on platforms violated the First Amendment. Unless the platforms get another stay pending rehearing en banc by the Fifth Circuit or review by the Supreme Court, the Texas law will go into effect, with potentially massive consequences for how the major social media companies moderate their platforms.<\/p>\n<p>The initial reaction to the decision among policy experts and legal scholars has been, to put it mildly, harsh. It\u2019s been called \u201c<a href=\"https:\/\/twitter.com\/steve_vladeck\/status\/1571145616029548545\">legally bonkers<\/a>,\u201d a \u201c<a href=\"https:\/\/twitter.com\/ProfDBernstein\/status\/1571217383951409152\">troll to get SCOTUS to grant cert<\/a>,\u201d an \u201c<a href=\"https:\/\/twitter.com\/Popehat\/status\/1570889517221158912\">angrily incoherent First Amendment decision<\/a>,\u201d and \u201c<a href=\"https:\/\/www.techdirt.com\/2022\/09\/16\/5th-circuit-rewrites-a-century-of-1st-amendment-law-to-argue-internet-companies-have-no-right-to-moderate\/\">the single dumbest court ruling I\u2019ve seen in a long, long time<\/a>.\u201d As someone who has <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3911460\">argued<\/a> for the constitutionality (and indeed desirability) of some government regulation of platform content moderation, I was hoping that the first judicial decision upholding such regulation would be a thoughtful and measured approach to what is indisputably a hard, even <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3256858\">wicked<\/a>, problem.<\/p>\n<p>Unfortunately, the Fifth Circuit\u2019s decision, written by Judge Andrew Oldham, is decidedly not that. Although not without its good points, it is largely a crude hack-and-slash job that misstates the facts and the law and ignores the proper role of an intermediate court, all in a sneering tone that pretends that those who disagree with it are either stupid or evil. It\u2019s an extreme example of <a href=\"https:\/\/www.lawfareblog.com\/first-amendment-absolutism-and-floridas-social-media-law\">First Amendment absolutism<\/a>: the insistence that the First Amendment has either nothing to do with content moderation or that it provides maximum constitutional protections to such practices.
