A terribly unfair way of putting it, of course, but the Lawfare<\/strong><\/em> folks do appear to be a little flustered at the thought of a Trump Presidency. \u00a0Here’s Paul Rosenzweig’s comment<\/a> on the matter:<\/p>\n

Four years ago, I wrote this blog post <\/a>on the idea of an internet kill switch \u2013 that is the ability of the President to act in a cyber emergency.\u00a0 In general I was skeptical of the concern that had been expressed by some civil libertarians who feared the possibility that a President could use existing legal authority to demand significant control over the telecommunications spectrum, including the network, for pernicious, political purposes.\u00a0 For one thing, the legal provisions were ambiguous and might not support such authority (if you are curious, you can go back and look at the analysis of Section 706 of the Communications Act of 1934).<\/p>\n

But I also expressed confidence that no President would act tyrannically.\u00a0 I wrote: \u201cany President of either party should not be presumed to exercise powers granted in a dictatorial way.\u201d\u00a0 So now, the question is — can we extend the same presumption to a putative President Trump?<\/p>\n

Contemplate that question as you consider the provision of law that says: “the President, if he deems it necessary in the interest of national\u00a0 security or defense, may suspend or amend, for such time as he may see\u00a0 fit, the rules and regulations applicable to any or all stations or\u00a0 devices capable of emitting electromagnetic radiations within the jurisdiction of the United States.”<\/p>\n

This is typical of many laws in the US — they often allow for Presidential waivers.\u00a0 That makes sense if, by and large, you trust their judgment.\u00a0 For myself, I am no longer as confident as I was in my anti-dictatorial assumption.<\/p><\/blockquote>\n

And I’m not in the least confident. Trump’s antics tend to emphasize a certain bullying, hectoring\u00a0pattern which should not go down well with the American public, such as the recent contretemps over Trump University<\/strong><\/em><\/a>, as covered by Maddowblog<\/strong><\/em>. We’re underdog lovers, not Putin lovers.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
