    The Take Care Clause plays a central role in Mueller\u2019s constitutional argument.\u00a0Jack Goldsmith and John Manning<\/a>\u00a0have studied the \u201cprotean\u201d nature of the clause and the many contradictory interpretations that courts have adopted; here, Mueller\u2019s analysis has some resemblance to the understanding set out by\u00a0Andrew Kent, Ethan Leib and Jed\u00a0<\/a>Shug<\/a>e<\/a>rman<\/a>, who argue that the Take Care Clause imposes a \u201cduty of fidelity\u201d on the president. Mueller does adhere to well-established readings of the clause as empowering the president to exercise prosecutorial discretion and to remove officers. But he also reads it as constraining presidential action, writing that \u201cthe concept of \u2018faithful execution\u2019 connotes the use of power in the interest of the public, not in the office-holder\u2019s personal interests.\u201d The duty to \u201ctake care\u201d can also be, as Kent, Leib and Shugerman write, a limitation on discretion.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"
