{"id":15044,"date":"2018-03-30T18:41:24","date_gmt":"2018-03-30T23:41:24","guid":{"rendered":"http:\/\/huewhite.com\/umb\/?p=15044"},"modified":"2018-03-30T18:41:24","modified_gmt":"2018-03-30T23:41:24","slug":"this-hole-looks-deep-ctd","status":"publish","type":"post","link":"https:\/\/huewhite.com\/umb\/2018\/03\/30\/this-hole-looks-deep-ctd\/","title":{"rendered":"This Hole Looks Deep, Ctd"},"content":{"rendered":"<p>Continuing the proactive thoughts on <a href=\"https:\/\/huewhite.com\/umb\/2018\/02\/21\/14366\/\" target=\"_blank\" rel=\"noopener\">deep fakes<\/a> that are coming our way, Jesse Lempel\u00a0<a href=\"https:\/\/www.lawfareblog.com\/combatting-deep-fakes-through-right-publicity\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/www.lawfareblog.com\/combatting-deep-fakes-through-right-publicity&amp;source=gmail&amp;ust=1522539509672000&amp;usg=AFQjCNE3cadCaOJE90xSzAuF_pXW_FPS3A\">publishes\u00a0<\/a>a post on\u00a0<i><b>Lawfare\u00a0<\/b><\/i>concerning a possible approach using current law on how to attack those who would generate deep fakes, at least domestically:<\/p>\n<blockquote class=\"gmail_quote\"><p>But there\u2019s another form of intellectual property that doesn\u2019t turn on ownership of a particular image or work: the \u201cright of publicity,\u201d which, as\u00a0<a class=\"m_-6511974340836659393gmail-twitter-timeline-link\" href=\"https:\/\/scholar.google.com\/scholar_case?case=4409160425583094683&amp;q=almeida+v.+amazon.com+inc&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\" target=\"_blank\" rel=\"nofollow noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/scholar.google.com\/scholar_case?case%3D4409160425583094683%26q%3Dalmeida%2Bv.%2Bamazon.com%2Binc%26hl%3Den%26as_sdt%3D40000006%26as_vis%3D1&amp;source=gmail&amp;ust=1522539509672000&amp;usg=AFQjCNHvkY1dwrITzcqa6tKMUEwkCMgkGA\">one court explained<\/a>, \u201cis an intellectual property right of recent origin which has been defined as the inherent right of every human being to control the commercial use of his or her identity.\u201d The right of publicity is a state law claim recognized in most states, whether by statute or common law (with slight variation among states), and is frequently invoked by celebrities seeking to prevent a business from unauthorized use of their images or identity in an advertisement. This is a tough question that has not yet been tested in the courts. Such a claim would need to get over three basic hurdles: (1) fitting the right of publicity into the Section 230 intellectual property exception; (2) counting deep fakes as \u201ccommercial use\u201d of identity for right-of-publicity claims; and (3) First Amendment protections on free speech.<\/p><\/blockquote>\n<p>I&#8217;d \u00a0never heard of the <em>Right of Publicity<\/em> before. Jesse goes on to analyze this approach, pointing out possible pitfalls and adverse previous rulings.
