{"id":1198,"date":"2015-06-02T18:56:40","date_gmt":"2015-06-02T23:56:40","guid":{"rendered":"http:\/\/huewhite.com\/umb\/?p=1198"},"modified":"2015-06-02T18:56:40","modified_gmt":"2015-06-02T23:56:40","slug":"is-north-carolina-the-most-toxic-state-in-the-union-ctd-4","status":"publish","type":"post","link":"https:\/\/huewhite.com\/umb\/2015\/06\/02\/is-north-carolina-the-most-toxic-state-in-the-union-ctd-4\/","title":{"rendered":"Is North Carolina the most Toxic State in the Union?, Ctd"},"content":{"rendered":"<p>In <a href=\"https:\/\/huewhite.com\/umb\/2015\/06\/01\/is-north-carolina-the-most-toxic-state-in-the-union-ctd-3\/\" target=\"_blank\">North Carolina<\/a>, educators win a victory, as noted in Indiana&#8217;s <a href=\"http:\/\/www.therepublic.com\/view\/story\/9d8aebbe11464b45bf5dd7aaa214cdec\/NC--Teacher-Tenure\" target=\"_blank\"><em><strong>The Republic<\/strong><\/em><\/a>:<\/p>\n<blockquote><p>North Carolina lawmakers violated veteran teachers&#8217; constitutional rights by passing a law that would remove job protections they&#8217;ve earned, the state&#8217;s Court of Appeals found Tuesday, but the court rejected efforts to restore newer teachers&#8217; pathway to the protected job status.<\/p>\n<p>Under the 2013 law, legislators sought to move away from a system that protected teachers from firing or demotion after they passed four years of probation and earned &#8220;career status.&#8221;<\/p>\n<p>Veteran teachers argued that the law violated constitutional rights protecting contracts and preventing governments from taking a person&#8217;s property.<\/p><\/blockquote>\n<p>The NCAE fights back and wins a victory on a 2-1 ruling, but it&#8217;s not the state&#8217;s Supreme Court.<\/p>\n<blockquote><p>A joint statement from state House Speaker Tim Moore and Senate leader Phil Berger said legislative leaders are reviewing the opinion and considering their options.<\/p>\n<p>&#8220;While we are disappointed with today&#8217;s ruling, we appreciate the thoughtful dissent,&#8221; they said.<\/p><\/blockquote>\n<p>The <a href=\"http:\/\/www.charlotteobserver.com\/news\/politics-government\/article22864011.html\" target=\"_blank\"><em><strong>Charlotte Observer<\/strong><\/em><\/a> notes:<\/p>\n<blockquote><p>Six teachers and the Association of Educators sued, and last year Superior Court Judge Robert Hobgood ruled that taking tenure from teachers was an unconstitutional taking of property rights.<\/p>\n<p>The decision did not apply to teachers who had not earned tenure. Supporters of phasing out tenure called the ruling \u201cjudicial activism.\u201d<\/p><\/blockquote>\n<p>(h\/t a North Carolina Educator)<\/p>\n<p>In other news, other citizens of NC protest the dubious actions of their leaders, as the <em><strong>Charlotte Observer<\/strong><\/em> <a href=\"http:\/\/www.charlotteobserver.com\/news\/politics-government\/article22844133.html\" target=\"_blank\">reports<\/a>:<\/p>\n<blockquote><p>Critics of the Republican-controlled state legislature gathered Monday night to induct several North Carolina lawmakers into a different kind of hall of fame: the Moral Monday movement\u2019s Hall of Shame. &#8230;<\/p>\n<p>The group displayed posters with photos of Mecklenburg state representatives Bill Brawley, Rob Bryan, Charles Jeter, Jacqueline Schaffer, and Sens.
