Google recently lost a court case in Canada, and the Canadian court&#8217;s ruling was that particular websites which happen to be infringing on intellectual property rights must be stricken from Google&#8217;s indices &#8211;\u00a0<b>world-wide<\/b>. What would be next? Hollywood forum-shopping its piracy cleanup north of the border? Or how about Europe looking to impose a &#8220;right to be forgotten&#8221; worldwide?\u00a0<a href=\"http:\/\/searchengineland.com\/top-european-court-decide-google-needs-purge-disputed-links-global-index-279262\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/searchengineland.com\/top-european-court-decide-google-needs-purge-disputed-links-global-index-279262&amp;source=gmail&amp;ust=1501107620280000&amp;usg=AFQjCNGP0eIzQGTnFztDaxeDilX150_XbA\">Survey says<\/a>.<\/p>\n<p>So what&#8217;s Google doing now?<\/p>\n<p>The company has filed a lawsuit in California federal court against\u00a0Equustek.<\/p>\n<p>&#8220;Google brings this action to prevent enforcement in the United States of a Canadian order that prohibits Google from publishing within the United States search result information about the contents of the internet,&#8221; states the introduction in the complaint (<a href=\"https:\/\/assets.documentcloud.org\/documents\/3900043\/Google-v-Equustek-Complaint.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/assets.documentcloud.org\/documents\/3900043\/Google-v-Equustek-Complaint.pdf&amp;source=gmail&amp;ust=1501107620281000&amp;usg=AFQjCNEzfdLzd8-fFKqOvIOXCJzabDrcug\">read here<\/a>, courtesy of\u00a0<em>Wired<\/em>).<\/p>\n<p>A federal judge can now give Google what it requests by issuing a declaration that the injunction is unenforceable as inconsistent with the First Amendment, the Communications Decency Act and international comity, but does it matter? What a U.S. judge can&#8217;t do is stop a Canadian court from imposing sanctions on Google for failure to comply with the injunction.<\/p><\/blockquote>\n<p>I&#8217;ll bet\u00a0<i><b>Equustek\u00a0<\/b><\/i>wasn&#8217;t exactly pleased to see\u00a0<i>nouveau-behemoth\u00a0<b>Google\u00a0<\/b><\/i>calling it into the court. But, of course, this is an embodiment of the inevitable clash of a naturally global entity with the artificial lines of nation-states. As noted before, what happens when an authoritarian state court issues a demand to\u00a0<i><b>Google\u00a0<\/b><\/i>that it take something out world-wide?
